ABSTRACT In this paper I propose that examining Locke’s response to skepticism requires us to consider at least three distinct senses in which skepticism appears on the horizon of the Essay. Skepticism is addressed, directly or indirectly, (i) as a general outcome of philosophical inquiry, (ii) as a methodical decision to doubt, and also (iii) as the result of a particular problem that challenges the claim to knowledge. I think that by examining how Locke reacts to such issues, we get (...) a more accurate and nuanced picture of Locke’s relationship to skeptical philosophy. (shrink)

Neste artigo examino a noção de ataraxía tal como presente no ceticismo pirrônico de Sexto Empírico. Meu propósito é mostrar que, a despeito de conservar aspectos que parecem estar a ela associados desde a filosofia de Pirro, o sentido da noção de ataraxía muda substancialmente e passa a possuir, ao menos nas Hipotiposes, um aspecto fundamental de ordem “intelectual” associado à supressão de um tipo específico de perturbação filosófica. Pretendo igualmente mostrar que tal peculiaridade permitiria compreender como ele se relacionaria (...) de modo coerente com a noção de investigação cética pirrônica e, para tanto, como ele se associa com a noção de “terapia filosófica” e de “epokhé sobre todas as coisas” que se fazem presentes na obra de Sexto. Neste artigo nos apoiamos em testemunhos diversos de Francis Bacon a respeito da relação entre sua filosofia e o ceticismo filosófico para estender o exame desse ponto ao âmbito de sua ?Doutrina dos Ídolos?. Pretendemos mostrar que, se por um lado as semelhanças revelam-se aí significativas , pode-se também observar, de outra parte, que já nessa Doutrina Bacon prepara uma via diversa da que atribui aos céticos, tanto em vista do modo como compreende a noção de natureza humana, como do (...) encadeamento metódico a que ele submete o material que toma dos céticos. O propósito deste artigo é o de examinar o ceticismo sobre a moral e as leis tal como abordado e respondido por Guy de Brués nos seus Diálogos contra os Novos Acadêmicos (1557). Proponho que, para uma apreciação adequada desse tema, é preciso distinguir dois níveis em que essa filosofia se apresenta na obra: aquele em que ela é exposta na fala dos personagens incumbidos de defendê-la (sustentando diferentes versões da tese de que “tudo é opinião”) e aquele que é (...) discernível através de alguns pontos de acordo ao longo das discussões, no qual revela-se antes uma afinidade entre os interlocutores com a Nova Academia. Esta situação aparentemente paradoxal pode ser melhor compreendida se cotejamos os Diálogos com a declamatio paradoxal ou o diálogo filosófico de matriz ciceroniana. De modo mais geral, sugerimos que o papel da filosofia da Nova Academia, especialmente em sua dimensão moral e política, é maior do que usualmenre reconhecido na redescoberta do ceticismo na França do século XVI. Richard Popkin’s seminal study on the revival of skepticism from the late Renaissance onwards gave a prominent role to Pyrrhonism, rediscovered through the translation of Sextus Empiricus’s writings into Latin and their usage in Michel de Montaigne’s Essais, among other works. Este artigo examina a concepção de História Natural de Francis Bacon a partir de sua relação com literatura cética discutida no século XVI. Mais exatamente, procura mostrar que essa obra representa uma radicalização de uma tendência naturalista presente no tratamento cético da noção de “milagre”, tal como reconhecível no De Divinatione, de Cícero, e nos Ensaios de Montaigne, dentre outras obras.

O objetivo deste artigo é examinar como Montaigne retoma, na sua crítica das filosofias morais e, especialmente, da existência de leis naturais, a proposta por Sexto Empírico acerca do mesmo tema ao final das Hipotiposes Pirronianas. Pretendo mostrar que, para além das consideráveis similaridades, o modo como Montaigne relaciona razão, natureza e costume, confere um perfil próprio à sua reconstrução do pirronismo, particularmente visível na sua compreensão da oposição entre critério de verdade e critério de ação. Igualmente, sustento que essa (...) distinção, proveniente do pirronismo, ocupará um lugar central na sua reflexão moral. The aim of this paper is to investigate how Montaigne adopts, in his own discussion of moral philosophies (and, in particular, of the proponents of natural laws), Sextus Empiricus' criticism on the same topic, as exposed in his Outlines of Pyrrhonism. I want to show that, besides the deep similarities we can find between them, Montaigne's peculiarities show themselves throughout his way of dealing with relations between reason, costume and nature, as well as in his interpretation of the opposition between a criterion of truth and a practical criterion. Neste artigo, propomos uma leitura do argumento cartesiano do sonho segundo a qual ele deveria ser analisado como um entimema, isto é, como um argumento retórico portador de premissas elípticas. Mais precisamente, o princípio da dúvida hiperbólica, embora formulado no início das Meditações, desempenharia um papel crucial na inferência contida nesse argumento, que o leitor comum que Descartes teria em mente tende a desconsiderar. Tentamos mostrar que este ponto poderia nos propiciar não apenas uma melhor compreensão do papel do argumento (...) nas Meditações, mas uma diferente compreensão da relação entre a filosofia cartesiana e a tradição cética. Possivelmente como decorrência dos efeitos ameaçadores e destrutivos que as duas grandes guerras mundiais trouxeram para o mundo, na segunda metade do século XX tornou-se mais aguda a preocupação com os problemas planetários. E, nesta esteira, um dos fenômenos emergentes foi a proliferação de organizações supranacionais e instituições voltadas para uma preocupação com as questões internacionais, especialmente aquelas cujos impactos adquiriam âmbito global. A guerra fria, a competição pela hegemonia de nações imperialistas como EUA e União Soviética, impulsionou uma corrida (...) pelo protagonismo nas áreas militar, tecnológica e industrial, alavancando de maneira inédita e desmedida a exploração dos recursos ambientais. A busca dos resultados a qualquer custo, no intuito de otimizar os lucros, tornou-se a finalidade do capitalismo neoliberal ancorado em corporações multinacionais, que hoje se tornou preponderante em termos globais. E isso inclui o esgotamento dos recursos naturais, se isso for condição para lucros maiores. Em face deste cenário, apesar dos governos e instituições supranacionais se articularem no sentido de promover o desenvolvimento sustentável, de se organizarem eventos periódicos para a defesa do meio ambiente, as iniciativas implementadas mais parecem paliativos ante a voracidade dos mercados. Como, pois, enfrentar efetivamente este paradoxo? Existem perspectivas efetivas de sua ultrapassagem? A reflexão aqui trazida se propõe a abordar estas questões e as implicações a elas inerentes, partindo de uma base teórica discursiva de inspiração habermasiana para analisar o fenômeno da sustentabilidade em nível planetário, sob uma ótica democrática e cidadã (cosmopolita e ativa). Current knowledge of the genetic, epigenetic, behavioural and symbolic systems of inheritance requires a revision and extension of the mid-twentieth-century, gene-based, 'Modern Synthesis' version of Darwinian evolutionary theory. We present the case for this by first outlining the history that led to the neo-Darwinian view of evolution. In the second section we describe and compare different types of inheritance, and in the third discuss the implications of a broad view of heredity for various aspects of evolutionary theory. Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. This article analyzes the notion of malaise resulting from the tension impulses between individuals and cultures, according to the results achieved by Freud's psychoanalytic reflexes. Despite certain moments in his work, it is possible to envision a certain possibility of emancipation of the individual through reflection or clinical analysis itself, or the psychoanalyst does not fail to notice a certain entropy present not only in the human being, but in the whole being alive. Ethical problems regularly arise during daily care in nursing homes. These include violation of patients' right to autonomy and to be treated with respect. The aim of this study was to investigate how caregivers emphasize daily dialogue and mutual reflection to reach moral alternatives in daily care. The data were collected by participant observation and interviews with seven caregivers in a Norwegian nursing home. A number of ethical problems linked to 10 patients were disclosed. Moral problems were revealed as the (...) caregivers acted in ways that they knew were against patients' interest. We used a theoretical interpretation according to Habermas' discourse ethics on the importance of dialogue when deciding moral courses of action for patients. This theory has four basic requirements: communicative competence, equality, self-determination, and openness about motives. (shrink)

Moreover, we show why germline EE is not effective and reject the position of strong epigenetic determinism. We conclude that EE is not always ethically preferable to GE in terms of risks, and end with suggestions for next steps in the current ethical debate on EE by briefly introducing ethical challenges of new areas of preventive applications of EE (III). Tendo estas questões em mente, este artigo visa indicar relações possíveis entre o antifundacionismo, o pensamento de Paul Feyerabend e os letramentos científicos. Em um primeiro momento indicaremos questões relativas ao antifundacionismo, e em seguida verificaremos como tal questão se efetiva no pensamento de Feyerabend. (...) Este estudio tuvo como objetivo comprender y describir las categorías que apoyan a la potencialización del talento de los investigadores, así como conocer los intereses motivantes del desarrollo de liderazgo. Se realizó bajo el enfoque cualitativo. Encontramos que la gestión del talento es obstaculizada por prácticas ineficientes en el reclutamiento, selección del personal, así como la ponderación de los incentivos monetarios en los investigadores para su (...) desempeño. Se recomienda abordar estudios de planes de sucesión en las organizaciones educativas para asegurar las reservas del talento clave. (shrink)

This paper explores essential characteristics of current nursing practice from the perspectives of clinically experienced registered nurses in various fields of health care in Sweden. Nursing practice has been the subject of much debate in the past and because of its complexity as well as continuous changes in society it is important to continue the debate. A qualitative study, including 16 group interviews with altogether 74 participants, was conducted. Nursing practice was viewed as a multifaceted field. The participants struggled to (...) define nursing but were able to describe it using concrete examples. The analysis, using interpretive description, identified current practice as essentially consisting of: ‘A practice pervaded by comprehensive responsibility’, ‘A practice that recognises a patient's unique needs’, ‘A practice based on multifaceted knowledge’ and ‘A practice that mediates between traditional values and changing demands’. Current nursing practice can be understood as striving to be in close proximity to the patient, but in tension with pervasive requirements and societal changes. Going forward, it is necessary to continue to reflect on and discuss the nature of nursing practice in an interprofessional context. Studies from primary and home care are also needed to broaden the understanding of nursing practice. (shrink)

This paper aims to contribute to the goal of finding influential legal precedents by quantitative methods. A lot of work has been made in this direction worldwide, especially in the context of common law jurisdictions. However, this type of work is extremely scarce in the Brazilian literature. In addition, our work also contributes to the research of network analysis and the law by applying these methods to unprecedented amount of data and narrowing our inquiry to a single law area, corporate (...) law. Furthermore, whereas most of the literature applying network analysis to judicial decisions had access to readily available data on the citations to precedent within each ruling, our raw data was nothing but the full text of decisions. We focus on data produced by the Superior Court of Justice, the highest court in Brazil for matters of federal law, including statutory interpretation of civil, criminal and corporate law. The Court issued an astonishing 282040 opinions tagged as related to corporate law between 2008 and 2018. This amount of cases is unparalleled internationally for superior courts and for studies in network analysis and law. In our results, we rank precedents quantitatively based on the citations they receive and make. We also qualitatively analyze some of the results, especially related to groups identified in the network with the Modularity algorithm. Our findings also reveal that corporate law jurisprudence in the STJ is quantitatively dominated by a few legal issues around one single theme that is only tangentially related to corporate law. That is, a type of contract used for the expansion of telephone landlines, which also allowed the consumer to become a shareholder of the telecommunication company. This comparison is especially pertinent because the utter lack of data on the quantitative weight of STJ precedents means the national literature has been operating in a void of objective measurements, one which has been filled with cherry-picked rulings and subjective ranking criteria. Ocorre que a crise dos Poderes Estatais dificilmente é diagnosticada pelas próprias instituições, que se escoram no discurso de “estabilidade institucional” para evitar mudanças. A simples positivação de direitos e garantias fundamentais, também chamada por Marcelo Neves de “legislação simbólica” ou “legislação álibi”; somada à adoção de ritos meramente formais (...) nos processos pelos Três Poderes, sem que se atenha aperspectiva substancial ou à efetividade dos princípios constitucionais - identificada como “procedimentalismo” por Lênio Streck e Écio Oto Ramos Duarte - acaba por acarretar verdadeira letargia institucional. At its inception, geoethics was envisioned as a type of professional ethics concerned with the moral implications of geoscientific research, applications, and practices. More recently, however, some scholars have proposed versions of geoethics as public and global ethics. To better understand these developments, this article considers the relationship between geoethics and environmental ethics by exploring different aspects of the human-nature relation (i.e., the moral status and role of humans in relation to the non-human world). We start by noting that the (...) main strains of geoethical thought elaborated so far represent examples of environmental virtue ethics and defend moral weak anthropocentric positions (e.g., “ethical”, “responsible” or “enlightened” anthropocentrism). Some scholars propose that such weak anthropocentric geoethics can synthesize the different positions in environmental ethics and move beyond them toward a novel and distinct approach. We compare the meaning and the use of the term “anthropocentrism” in both environmental ethics and geoethics, stressing that although geoethics is inevitably epistemically anthropocentric (i.e., anthropogenic), it does not need to be morally anthropocentric. We consider the compatibility of non-anthropocentric stances with current geoethical theory and argue for the integration of normative non-anthropocentric accounts (e.g., ecocentric) into geoethical debates and geoscience education. Apesar da exegese bíblica empreendida no Leviatã ser a ferramenta que ampara a defesa de Hobbes de que alma é mortal, o artigo pretende destacar que a doutrina da mortalidade é consequente à defesa hobbesiana de que tudo o que existe é corpo, de modo que a doutrina contrária, a da imortalidade natural, não se opõe apenas à jurisdição da soberania, mas à própria natureza das coisas, que inevitavelmente adestra a leitura do filósofo da palavra revelada de Deus.

Research suggests that institutions affect the levels of corruption in a country. We take these arguments a step further and examine whether it is the presence of inclusive institutions and/or the credible and consistent implementation of institutions that matter, as regards corruption. We use a novel approach to theoretically conceptualise and empirically operationalise institutions along two analytically distinct dimensions: the nature of the institutions (the de jure dimension), and the extent to which they are credibly and consistently implemented over time (...) (the de facto dimension), using a panel dataset for 148 countries covering 2012 to 2018. We find that formal institutions are most effective in reducing corruption when the rules are credibly and consistently implemented. Furthermore, this effect appears to operate differently at different levels of national income. The nature of the formal institutions appears important across income levels, but particularly so at the upper middle income level, while the credible and consistent implementation of these institutions is primarily influential at upper middle income levels. We explain why this may be the case and elaborate on the policy implications. (shrink)

Infants who suffer severe neglect fail to thrive emotionally as well as bodily. The absence of early coexistential structures that provide well-being leads to a narrowing of the child's perceptual and social developmental horizon. What is the nature of these early structures? In this essay, an ontology of well-being or housedness is elaborated through phenomenological reflections on breast-feeding and infant perception. Merleau-Ponty's ontology of the flesh makes a contribution to the ontology of well-being: it gives us a conceptual and evocative (...) language to describe human existence in its pre-verbal, syncretic, and non-dualistic manifestations. It also allows for a re-evaluation and re-interpretation of the results of current research in infant perception. Through the structures of infant perception we perceive the coexistential fit between infants, other human beings, and the world of things. An infant's fundamental housedness in the flesh is taken up and cultivated or destroyed by the child's social and cultural environment. (shrink)

6 and 14 recently proposed taxonomies that distinguish between four processing states, based on bottom-up stimulus strength and top-down attentional amplification. The aim of the present study was to empirically test these processing states using the priming paradigm. Our results showed that attention and stimulus strength significantly modulated priming effects: either receiving top-down attention or possessing sufficient bottom-up strength was a prerequisite for a stimulus to elicit priming. When both top-down attention and sufficient bottom-up strength were present, the priming effect (...) was boosted. The origins of the observed priming effects also varied between different processing states. We can conclude that our empirical study using the priming paradigm confirmed the presence of four processing states, which displayed a differential pattern of response priming effects and differential origins of the response priming effects. The present study aims at understanding how Ethica Nicomachea V.6 relates to its preceding chapters, V.1-5. On the one hand, the interpreter wonders for what purpose Aristotle introduces a topic named ‘the civic just’ (to politikon dikaion) in V.6, since V.1-5 treats extensively of matters of justice in the city. On the other hand, the same text posits that there is a certain ‘just without qualification’ (to haplōs dikaion), which may or may not be the civic just itself; compared to (...) the just without qualification, other forms of just are so by similitude (kath’homoiteta). In attempting to clear the confusion around those two points, the present study proposes the following: (1) the civic just is the just without qualification insofar as it is the primordial form of the just, in which only humans who are cumulatively free, equals and self-sufficient have a share; (2) the description of the civic just recapitulates several aspects of the discussions of justice in V.1-5 – the laws, the kinds of equality, rule, the legal suit - because the civic just encompasses all the forms of just (dikaion) related to the virtues of universal justice (V.1) and partial justice (V.2-5); (3) the expression to politikon dikaion is introduced in V.6 in order to contrast everything treated in V.1-5 with the domestic just, to oikonomikon dikaion, mentioned for the first time in V.6; (4) the forms of the domestic just are just only by similitude with the civic just because justice loses density outside the civic sphere, a situation which can be explained by the shortcomings Aristotle ascribes to women, children and slaves in EN V.6 (lack either of freedom or equality or yet self-sufficiency) as well as in Politica I (varying degrees of defective deliberation and virtue). O objetivo do texto é não apenas explicar a contribuição da filosofia de Nietzsche no atual debate em torno da filosofia das emoções, por meio da aproximação teórica com o emocionismo de Jesse Prinz – especialmente da abordagem das emoções entendidas como sentimento –, mas, sobretudo, defender a tese da compatibilidade da abordagem cognitiva e não cognitiva das emoções. Assim, se por um lado, emoções são acompanhadas de sinais somáticos, por outro lado, emoções também representam preocupações (Prinz) ou avaliações (Nietzsche) (...) sobre algo no mundo. A tese compatibilista auxilia na solução de duas sérias objeções ao sentimentalismo: a determinação do conteúdo das emoções e a individualização das experiências emocionais. Essa conclusão é mais bem compreendida, além disso, por meio da hipótese disposicional. (shrink)

A guerra civil iniciada no final de 2013 no Sudão do Sul causou, pela primeira vez na história das Nações Unidas, um afluxo gigantesco de deslocados internos para o interior de bases da Missão das Nações Unidas no Sudão do Sul, em busca de proteção. Assim, foram criados os Protection of Civilian Sites. Com a chegada de dezenas de milhares de pessoas em poucas semanas, houve um enorme crescimento nas demandas humanitárias e de segurança.
